Dear Department for Work and Pensions,
Can you tell me under what legislation gives DWP the authority to ban claimants from Job Centre premises?
What right of appeal do claimants who believe the ban is unfair and without foundation have?
Is the DWP aware that banning claimants without a fair hearing is an offence under the Human Rights Act?

A fair and public hearing (or trial) You have the right to a fair and public hearing if:
you are charged with a criminal offence and have to go to court or
a public authority is making a decision that has a decisive impact upon your civil rights or obligations."

We’ve requested they revisit their decision to ban him
but what does he do in the meantime? The only thing I can think of is that we request he is allowed to sign on by post.

@helping_hand do you have any stories to share of people being banned from JCP and getting "special" treatment from DWP?
I been wondering myself if I should been openly recording everything at JCP.. and then make a living on posting all the drama on Youtube

jara we dont advice users to post there info on youtube
however we do advise people to record the events as a just incase situation

Fair enough.
If someone been banned for recording audio, and alternative arrangement have been sorted for that person during a period of time. Can this person be banned again during this period of time if they continue recording? Would alternative arrangement for the previous alternative arrangement be sorted?
I know full well it's not recommended, but I just wanted to know what's the worst DWP can do if someone is insisting on recording (and won't ever stop).

I think the best approach is not to admit you are recording and to use the information gathered covertly as a last resort i.e. a Tribunal Appeal submission or an ICE complaint.

didnt get banned however for informing that i was recording
not one advisor would see us or sign us on so you can guess the outcome of that
manager and advisor always asked if i was recording the answer was yes then manager made it clear if recording no one will see you in this jobcenter
no other offer of another jobcenter was offered however a psych was issued by dwp of an offer of a meeting

I try to record everything at the Job centre.
Do not tell them that you are recording! It can be used, if transcribed for use in court.
The courts use the law to decide on a case and not just "general information" that the Job center often rely on.

Life can be less stressful for some i.e in and out of the Jobcentre at the speed of light (sign on and out) and no referral to DWP provision etc.

It is a well known relationship: the more iniquitous are laws and rule the more licentiously they are applied.
When the rule of law disproportionally aim at oppressing, they create an incentive for those that apply them, to extend the remit of their powers.
It is a common sight in the more totalitarian regimes, where being zealous is a job requirement for civil servants.
In our case, the combination of repressive (and equally inane) rules, fully supported by and evil management and the absolute certainty that no consequences would befall any lower functionary, regardless of how much they pursue the persecution of their charges, create a toxic mixture.
One where people rights are more and more disregarded, one where DWP employees are trained in cruelty.

DWP WCs willfully ignore their own rules and the law (such as the Health and Safety Act that underpins their misuse of the UCB policy) in their zeal to prove to themselves that they aren't in the same boat as the rest of us - that their "employer" (the psychopathic State) won't throw them to wolves as well. Sadly they are mistaken.
