I am now thinking of doing a postgrad' course relevant to my usual work. The uni' needs evidence of work experience in this arena. No problem with that, my past work meets that criteria.

The problem: I took my employer to a tribunal because the employer was embezzling staff wages. I won my money back but not before the employer made a series of very serious false allegations against me. These allegations were dismissed by the ET judge and not mentioned in the final judgement (because the case was about the employer stealing, not about me).

I am fearful to list this employer on my uni' application in case the employer repeats the false allegations when contacted by the uni'

I would add that if the false allegations had been true, then the employer would have every right to take disciplinary action/ report me to my governing organisation and / or the police. None of which happened as the employer knows s/he lied about all this to discredit my case. I am not sure the uni' will believe that though.

The course I want to do is very competitive scratch

Any advice would be appreciated. Thanks.

I would suggest checking the reference you might receive.  

Do you have a trusted friend who could pose as a reference checker?  Alternatively, you could use a background checking service.

Once you know what is being written you can then decide what to do.

With regard to these checks, I have found another thing out. These companies can check if someone is on the electoral register. I wonder what happens in cases when someone has not registered to vote and so does not appear on it.

The background checking company only carries out relevant checks.  You will be informed what checks are going to take place with your consent.

You could ask a company simply to do a reference check.

A friend recently started work for a financial organisation.  She was encouraged by a DWP provider to stretch the dates for one job on her CV and worried needlessly about failing the checks.   She did inform the employer about the discrepancy before she was offered the post, which may have helped.

I should imagine electoral roll checks may only be applicable to a very limited number of job roles.

a question Caker ... if your previous employer did repeat these false allegations to the uni, have you any paperwork to show the ET tribunal rejected them?

To be honest tho' - it would be bad (for them) if your ex-employer said anything like that to the uni (you could start a court case against them for defamation of character if they did Wink )

I have no paperwork to indicate the false allegations were rejected. The case was about the employer not recording holiday pay correctly (rolled up holiday pay included in hourly rate instead of additional to it). The case was never about anything I did, but the employer did not take legal advice, and wrongly assumed that making counter allegations would help his defence. The judge made it clear in court that the case was not about these counter allegations. The written summary does not mention them at all, but just mentions how the employer had broken the law and is actually all about him and not me.

@ND, thanks for the link. Hopefully the employer will realise that no interests are served by telling lies about me.

I was thinking the same thing. I hope the uni' will not look too far into things as I have someone to write my actual reference. When I contacted the uni' they said they don't always follow up on employers listed on the ap' form in every case, even if they are considering the application, they might / might not follow up in every case. It seemed a bit vague so I hope to wing it. Help with a career issue please 2035158131
