Managed Migration from Legacy Benefits to Universal Credit
Quotes from a DWP FOI response: Dated 26th March 2019:
“We are committed to delivering managed migration in a way which supports claimants. In 2019, and in line with our Test and Learn approach, we will test and refine our approach with a very small number of claimants from July 2019 to check that it is working well, before we take on larger volumes in 2020. We will complete the managed migration process by the end of 2023.”
“‘Managed Migration’ is still in development, all we have made public at the moment is that we will pilot an approach with up to 10,000 claimants from July 2019 in Harrogate and then once this is completed, we will go back to Parliament with further regulations to undertake the process completing in 2023”.
“Civil servants and, increasingly, external experts and stakeholders will be involved at various stages of the policy process. The issues under discussion at the last stakeholder meeting are so current it would have an impact on implementation policy formulation if this information was released. In effect, we are iterating the design of the pilot as it is developed and then run across the coming year, so we can make determinations about the final design for the full ‘Managed Migration’ phase from November 2020”.

As I understand the above, a ‘test run’ or ‘pilot’ for ‘Managed Migration’ will commence in Harrogate, North Yorkshire, in July 2019. It will involve 10.000 claimants. The pilot is to be iterated and developed as they go along, God help Harrogate is all I can say to that. The ‘full Managed Migraition phase’ will not commence until November 2020 once a final design has been determined.
Legislation on the regulations for managing migration from ‘Legacy Benefits’ to Universal Credit has not yet been enacted by Parliament. However, draft legislation has been published.

In the meantime, there is no legislation specifically for ‘Migration’ that I can find.
The only current legislation on Transitioning, that I can find, is: - The Universal Credit (Transitional Provisions) Regulations 2014:

Work coaches dealing with transitions from legacy benefits to UC must comply with those 2014 Regulations, the only ones currently in force. Should they presume to undertake the transference of a claimant, otherwise than as legislated for in the Transition S.I. they will be acting outside the law, i.e. illegally.
