This outcome is one of the many reasons I enjoy the the law and the legal process.  It is never perfect, but in many cases common sense prevails, this is such a case...

an interesting subject it comes from mabon vs mabon where a child of prescribed age has the right to choose over a parent however in light of the above info

the child was wrong in this case however if the father remained in the uk the child should have the right to choose which parent they want to live with
