DWP are using this guide unlawfully to sanction people.

None of the UC CCs I have seen have specified the required time for any particular action, which the SoS is entitled to do!

17 Work search requirement

(1) In this Part a “work search requirement” is a requirement that a claimant take—

(a) all reasonable action, and

(b) any particular action specified by the Secretary of State,

for the purpose of obtaining paid work (or more paid work or better-paid work).
(2) The Secretary of State may under subsection (1)(b) specify the time to be devoted to any particular action.

In the absence of this information the guide presented is not worth the paper it is written on!

Thanks for replying. Yes, that's it.
Can't remember who the discussion was with-  but someone posted what I think was some dwp guidance which gave estimations of time it might take an individual to do various ' work search actions'
For example
Time it takes to apply for a job via email- 30 mins etc.
Time taken to check emails - xx mins
I've got a UC sanction where decision maker has have been very specific about time it took to do x actions
Questioning how this  decision was reached....what was timing based on?

I also found this more rational statement
"We do not intend to set out in guidance how long any particular activity should take as this will vary from claimant to claimant." P.5

I have signed at the same JCP office for over 6 years apart from a sabbatical I took to reset my time to avoid milestones on the JSA,i have been there longer than most of them that work there.

When I see advisor's when out and about they nod their heads in recognition that they know me, obliviously some think I work there, they seen that face before.

I am on JSA, single no health issues so ripe for the greatest scrutiny as to why I seem unable to secure employment after so long.

I have never had a doubt raised although sailed pretty close to the wind at times nor a sanction, and my job search has never been doubted,  so I must be doing something right somewhere along the way so I will explain how I produce my evidence each fortnight in the hope it might help someone else in some way.

My intentions are to never work so it can be adjusted if your actually interested in such things.

I use the paper templates.

Most JCP offices issue these to be filled in,
Mine is headed

Date+Duration -  Name of place/website visited -method of application -contact name - outcome/feedback.

And contains 31 sections or steps.

Duration

Do not fill in duration if you do then you might struggle to make up your hours, or end up being interrogated why your not doing enough hours or X should not take that long etc, leave duration blank, no compulsion on our part to fill in everything.
Write big so the date fills the box.

Date

This pretty much a given there are 31 sections so for two weeks that means we have to take more than 2 steps per day plus a few to completely fill the form so use two sections per day give or take a few days. so we fill that in correctly.

Name of place/website

This self explanatory so just go down the section fill in with UJM,Reed,Indeed, gumtree, daily paper, shop etc mix and match them does not matter if your CC states sites, steps, places to visit etc, newspapers, speculative so fill them in here.

Method of application
Less of a trail we leave less to come back on us so postal applications are a godsend and so are telephone applications and family friends shop windows can all be easily fabricated, make them up to fill in some of them steps.

The idea here is to lie out your back teeth, do not take any steps at all if you so desire, but make sure you document every step in your claimant commitment.

So now fill the rest up with real or fake jobs, Job ID real or not and real or fake telephone numbers it matters not no one is going to contact them.

I have 6 paper templates filed in completely and then copy one of them adjusting the date only takes me 1 hour to do the day before signing, they do not record or keep the templates.

If you make the mistake of putting only the truth then you will find it extremely difficult to satisfy the criteria and this is where I see a lot of people stumble.

Honesty gets you no where when dealing with the lords of the lies.

I have never been asked to evidence my steps, my template ticks all the boxes and so I have a relatively easy time for now as I am approaching another milestone the end of my work program.

This is probably very bad advice but it has worked for me so far but the difficulty is it might not for you.

I have to show what I've done for 35 hours to work coach even though I'm still on jsa. I write the same shit down on paper everyweek.
Monday
Jobsearched on internet- 3hours (they can't prove you didn't)
Looked in papers-30 minutes (they can't prove you didn't)
Practiced interview questions- 1 hour ( they can't prove you didn't)
Applied for 3 jobs on reed- 30 minutes for each job, write down job ref ect.
Repeat everyday and the day before my appointments I print out the list of email confirmations I recieve.

DWP has a devised a very crude tool, which has been was used to sanction UC claimants based on the times specified within the template, which is very wrong and I believe it would not be condoned by any Tribunal Judge.

I am in a very similar situation, although  I have less then two years till retirement (if there is still one by then...).
I used a template too for the evidence of being ASE. It was based on an old form from the JCP.
I am not sure it is on this site, although I left a copy on the old UM one.

I attached it for everybody convenience.
It is in Open Office format.

The template can be found and downloaded here (bear in mind it is hosted on a Google drive so that it will be displayed using the Google Document format, when downloaded and open with a Libre Office Writer word-processor it should display correctly)
