Chantelle said the council told her that the council couldn’t help until the day that she was actually evicted from the flat – when the bailiffs turned up at her door, as she understood it. She said she was advised to stay in the flat and to wait to receive a possession order – which, I gather, is the next stage in the so-called system (the possession order is mentioned in the officer email below). This was, needless to say, of concern. Chantelle wanted help as soon as possible. She wasn’t keen to wait until bailiffs hammered at the door. She was also worried that she’d end up with court fines and costs if things went as far as possession orders and bailiffs (this is exactly what happened, as you’ll see). I'm going through a similar situation, though I'm a private tenant.... Council are useless. To quote 2 parts from the above:

Outside of that, Chantelle said the main advice she received was to search by herself outside of Newham for a flat that she could afford at local housing benefit rates and a landlord who would accept housing benefit.
“The receptionist [an officer Chantelle spoke with at Newham] said, “you could look for private rented…” She said you can go on stuff like Zoopla, Rightmove…. I’ve done that, like, every day. I’ve called, like, 50. Not one of them takes DSS. Not one.”

been through this myself twice
whatever you do dont leave voluntary you have to be evicted from the property or your classed as voluntary homeless
the landlord has to give you notice to leave the property, 1 month
then they organise a court date as you havent left the property at end of 1 months notice
after court date you get a court order to vacate the premises (beaware of this one theres 2 1 is 24 hr notice the other is weeks or months notice )
get your date for leaving the property at court by asking for the date
council do nothing until your made homeless on the day
other than that get on the register to be rehouse keep bidding on propertys dosnt mean you will get one but its worth doing
on final day for me and 2 children we ended up at a hostel homeless we stayed as a family and soon left i found it interesting that ss was also coming to the hostel as well as taxi place was told to not pick us up as i was told by the taxi firm on re ringing for a taxi to ask where it was.

Anyway, I'm definitely staying put, she hasn't even mentioned giving a written notice. I think she'd prefer I left before she had to "sell" the house, and she could easily let out this property to a "professional" person at double the rent she's getting now from my HB. Also on investigation I understand getting a court order to leave can take 3 to 4 months? That'd give me a little bit more time, but thanks for the advice about finding the leaving date from the court, should it ever come to that.

AFAIK, you are not obliged to let anyone enter the property while you remain a tenant. That could scupper any estate agent or potential buyers having a look. Of course, the situation could be different once notice (to leave) is served.
I am not legally qualified so this needs to be triangulated with a legal source.

I already have plans should potential buyers turn up, Caker. It helps having the neigbours from hell, I'll just ask them to crank it up a bit whenever anyone visits...
Meanwhile, I shall continue my hopeless search for a property. Why so many landlords are against taking anyone on benefits I don't know...

As a tenant, you also have a right to peaceful enjoyment of your rented property. Renters are free to close the door to everyone they don’t want in their home. You’re not obliged to let in estate agents, prospecting buyers or other persons for viewing purposes. The landlord can send you a 24 hour notice for a personal inspection of the premises. However, you’re still able to deny them entry. In fact, without a court order, you can even close the door to the police. Landlords are allowed to enter in cases of emergencies like fires or gas leaks.

I think a good approach for anyone claiming benefits is to obtain an excellent reference from the landlord, this will assist both parties. Long term tenants who have maintained the HB rent and kept the property in a good condition save for wear and tear should be considered favourably. Anyone can lose a job at any time.
I would suggest emailing or ringing landlords who state no DSS to discuss your particular situation.

just to give you an idea you are a sitting tennant and the house can be sold with you being in it as a sitting tennant
its advisable to allow the estate agent and clients view the property but stay out of it is the best approach
as goes for yourself you will have had a rolling tenancy its still one months notice then down the court rd however has to be written notice not verbal notice dont tell them this though
i was lucky ex landlord gave me 5 years tenancy she had to pay us out if she wanted rid of me
its 24hrs notice or 48 hrs notice to view the property or show clients around
the next time video it then send the video to the owner they cant beat that comment they are trying the route your refusing to alllow access to the property
at moment your playing with verbal notice you leave its voluntary
1 months written notice first then its the court paperwork date
at court get the leaving date whilst your there

wait till last day and get evicted from the property have all your stuff out by this day

ive been through it twice mary once private then council tenant
always take advice in these situations but it helps when someones been through it already
i also did the same landlord never came round to check on the property i could do as i please with the place he got his rent i could do the repairs so did so never bothered ringing them for anything
just lucky that landlord had told me what he had done and i got the agreement off him for it as well
no back rent if you had the agreement in writing that you did the repairs so no extra charges was included the landlord would have to welch them when they took them over
like i said be civil with the estate agents and the new landlords no trouble from you whilst viewing the property is best way as they could be your new landlords however the tenancy agreement falls to them once they buy the property but be aware they dont have to adher to the repayment of your bond
they will accuse damage to the property so take photos when leaving the property or keep one months rent back
photos prove a lie in court if needed and dont forget wear and tear so any old photos you have of the property you might need so keep them close just incase you may need them if you want your bond back from years ago and new landlord takes on the agreement that was signed years ago
but watch out for a new tenancy you dont have to agree to it

The agreement that I would carry out all repairs in exchange for no rise in rent was only verbal/by email.
