DWP systematically spreads misinformation - disability benefits

Entitlement to ESA pending appeal is enshrined in the ESA Regulations to cover the whole of the period leading up the hearing. It is also possible to have the payment backdated to cover the MR phase too. However, ESA pending appeal is not paid automatically – claimants must get fit notes from their GP, and present these along with their appeal acknowledgment letter from HMCTS, to their local Job Centre. The Job Centre should report back to the DWP who will arrange for ESA pending appeal to be paid.

i found with my sick notes jobcenter refused to accept them

quoting that i had to send them into a place with an address so i asked for the letter envelopes so i could post them

this was in 2014 at the time

Well I really did not know that. I thought that people needed to claim JSA (and remain subject to jcp intervention) once they failed the WCA.

That is right Caker.

If an ESA claimant's benefit is stopped after failing the WCA, they can rely on JSA or their own funds while they progress their appeal.  However, once a Tribunal appeal is lodged with HMCTS the ESA claimant can have their ESA payment re-instated and back dated.  However, this does not happen automatically, the claimant has to apply and provide Fit Notes covering the relevant period.  

The misleading letter is informing GPs not to issue any more FNs after their patient has been found fit for work by a DWP Decison Maker, which is wrong.

GPs need to made aware of this, as I am sure that some of them would not question the DWP letter.
