Subject: Complaint – Group Signing Sessions [town] Jobcentre

I am concerned my Jobcentre is falling foul of the JSA regulations and claimants are being sanctioned unlawfully.

I was issued with an appointment card to attend a GIS (see att.) and to provide a declaration.

The relevant legislation: Attendance, information and evidence.

8.Attendance, information and evidence.
(1)Regulations may make provision for requiring a claimant [F1(other than a joint-claim couple claiming a joint-claim jobseeker’s allowance)]—
(a)to attend at such place and at such time as [F2an employment officer] may specify; and
(b)to provide information and such evidence as may be prescribed as to his circumstances, his availability for employment and the extent to which he is actively seeking employment.

Attendance 23. 1 A claimant shall 2 participate in an interview in such manner, time and place as an employment officer may specify by a notification which is given or sent to the claimant and which may be in writing, by telephone or by electronic means. 3 Attendance by members of a joint-claim couple 23A. 24.—(1) A claimant shall provide such information as to his circumstances, his availability for employment and the extent to which he is actively seeking employment as may be required by the Secretary of State in order to determine the entitlement of the claimant to a jobseeker’s allowance, whether that allowance is payable to him and, if so, in what amount.
4 (1A) A member of a joint-claim couple shall provide such information as to the circumstances of each or either member of a couple, the availability for employment of each or either member of the couple and the extent to which each or either member of the couple is actively seeking employment as may be required by the Secretary of State in order to determine the entitlement of the couple to a jobseeker’s allowance, whether that allowance is payable to the couple and, if so, in what amount.
(2) A claimant shall furnish such other information in connection with the claim, or any question arising out of it, as may be required by the Secretary of State.
(8. Where, pursuant to paragraph (1)1 , (1A) or (2), a claimant is required to provide information he shall do so 2 at the time he is required to participate in an interview in accordance with a 3 notification under regulation 23 1 or 23A, if so required by the Secretary of State, or within such period as the Secretary of State may require.
(9) Where, pursuant to paragraph (4) 4 , a claimant is required to provide certificates, documents or other evidence he shall do so within seven days of being so required or such longer period as the Secretary of State may consider reasonable.

DWP policy: Booking a Group Information Session

If the event is voluntary, claimants must be notified with a letter outlining what the GIS is about, not a card, so they can make an informed decision whether to attend or not.

19.The Group Information Session is booked using the LMS interview type
‘Group Info Session (Non New Deal)’.
20. The appropriate clerical Group Information Session letter below, in place of the system generated claimant appointment letter relating to this interviewtype.

If the event is mandatory and will be specifically beneficial to the claimant a JSD can be issued if it is unlikely the claimant will attend:

Note 2: Consideration should also be given as to whether the claimant is likely to undertake the action voluntarily. If so, the need for the JSD may not be required and the time spent creating one negated.
Note 3: Participation in any work experience opportunity is voluntary (see DMG34951) and so a JSD cannot be used to mandate a claimant to take part in a work
experience opportunity.
Note 4: A JSD cannot be issued to mandate a claimant to give JSP access to their UJ account (see DMG 34912).
Note 5: A JSD should not be used to mandate a claimant to attend a Group Information Session (see DMG 34911).

A separate notice to attend a work search review (signing on appointment) must be notified via an ES40JP or its replacement

Relevant notification 34835 The meaning of “relevant notification” in DMG 34834 is a notification to the claimant of when, where and how they are to participate in an interview1 but which is not a notification to participate in an employment programme, training scheme, the MWA scheme or any other prescribed scheme.

Claimants cannot be mandated to give access to their UJ accounts and under the right to privacy, nor can they be monitored when using a computer (HRA).

The maladministration involved:

(i) Failures to follow procedure and the law
(ii) Abuse of process

The resolution

   The correct procedure is adopted.
   Sanctions applied unlawfully are cancelled
