Tom cannot show good reason for his failure to comply. He states he forgot about the interview.

The DM is satisfied that Tom was adequately notified of the requirement to take part in the follow up interview and of the circumstances of failing to comply and that it was reasonable in the circumstances.

The DM imposes a low-level sanction for the failure. At six months of the claim


This example tends to suggest that Tom could be mandated to be available on a specific telephone number on a specific date at no specific time and that should Tom (a) not get to the phone in time to answer it or (b) not hear it ringing (he may have been in the bathroom) then Tom will forfeit his benefit. Unfortunately "forgot" is not good reason in law unless there are particular circumstances.

I attended a Tribunal case where good reason was shown, because the individual was otherwise engaged with an important domestic matter and the case was allowed. Further, the official did not attempt to ring again.

It is unreasonable to expect a person to be at the end of their telephone constantly for the duration of a DWP working day.

@ND Good point. I would also hope that anyone getting caught up in this unpleasant DWP trap would not cite 'forgot' as their 'good reason'.

DWP have inserted a schoolboy error into their example. Perhaps the author was thinking of Tom Brown (Tom Brown's schooldays) lol!

In IMHO; To sum things up, DWP wants to save money by scrapping All Benefits; So the best course of Action is Crime; Drug Cultivation & Selling; And for the Ladies Prostitution; Oh how Very Conservative. Twisted Evil
