Outcome
The approach of the DWP to the Claimant, and to many other disabled benefit claimants, failed over a period of years to comply with its statutory obligations under the Equality Act 2010 (and, before that, the Disability Discrimination Act 1995). Those with disabilities that meant that they had difficulty communicating by post were, in many instances, unable to secure a satisfactory means of communication with the DWP. This in turn meant that some went without benefits that were essential to them. At the time this claim was filed the DWP had still not complied with its statutory duties in respect of the Claimant.

It is understandable that the Claimant should continue to be sceptical about the DWP's commitment to ensuring compliance with its statutory duties. His scepticism may prove to be well-founded. As matters stand, however, the DWP has offered the Claimant a system of communication that (subject to effective implementation) amounts to a reasonable adjustment and complies with its PSED. It follows that the claim for judicial review falls to be dismissed.

Pro forma to give to work coach to ask for reasonable adjustments

As I understand it, if you put in a formal request the jobcentre must respond addressing each of your points. Could be useful to take into a first interview when the claimant commitment is being drawn up, or at any point along the line to get it reviewed.

The leaflet is for JSA but obviously would work for UC/ESA as well

Disability & JSA Reasonable prospects

121.  Where the claimant imposes acceptable restrictions because of their physical or mental condition they do not have to show they have reasonable prospects of getting a job. However, they must show all the restrictions are reasonable and are connected with their health.

If the claimant has a physical or mental disablement they may place any restriction on their availability (even if it results in them not having a ‘reasonable’ prospect of obtaining employment) providing the restriction is ‘reasonable’ in light of their disablement.


Can someone please clarify what the above means in relation to discussing job search activity with a work coach every fortnight? What does "not have reasonable prospects" actually mean?
